These Terms of Use (“Terms”) govern your access to and use of the KZ Wellness, PLLC website(s) and any online services that link to these Terms (collectively, the “Platform”), and the services, content, and features provided by KZ Wellness, PLLC through the Platform (collectively, the “Services”).
“KZ Wellness, PLLC” “we,” “us,” or “our” means KZ Wellness, PLLC, PLLC and its affiliates. “You” and “your” mean the person accessing or using the Services.
By accessing or using the Services, clicking “I Agree,” checking a related box, or using any other acceptance mechanism, you agree to be bound by these Terms. If you do not agree, do not use the Platform or Services.
If applicable, your membership may automatically renew unless you cancel as described below.
The Services are intended for individuals 18 years of age or older. If you are under 18, do not use the Services.
Your use of the Services is conditioned on your compliance with these Terms and all applicable laws. Our Privacy Policy and Notice of Privacy Practices are incorporated into these Terms by reference as well as in separate documents. We may update these Terms from time to time by posting a revised version with an updated “Last Updated” date. Your continued use after changes are posted constitutes acceptance.
KZ Wellness, PLLC provides access to licensed healthcare professionals (“Providers”), third-party pharmacies (“Pharmacies”), and The Shoreline Therapy Center (“Therapy”). These Providers, Pharmacies, and Therapy are independent and are not employees or agents of KZ Wellness, PLLC.
KZ Wellness, PLLC is not an insurer and does not offer insurance. The initial consult and monthly membership fee covers access to the telemedicine platform, telehealth visits and messaging, and lifestyle guidance features. Medication and other third-party services are not included and are billed separately by those third parties.
Telehealth involves care via electronic communications when you and the Provider are not in the same location. Telehealth may not be appropriate in all situations. You must review and accept our Telehealth Consent before receiving telehealth services. Providers may determine that an in-person evaluation is necessary.
Technology requirements:
Smartphone/tablet/computer with front-facing camera
Reliable internet (≥5 Mbps down / 1 Mbps up)
Updated Chrome, Safari, Firefox, or Edge
Private, well-lit location
If technical issues occur:
Brief interruptions: wait for reconnection
Extended issues: Provider may call the phone number on file
If a visit cannot be completed due to technical issues, we will reschedule at no additional cost
Multiple failures may require an alternate device/connection
Appropriate for: weight management consultations and monitoring; medication management for approved prescriptions (e.g., GLP-1/GIP when appropriate); routine follow-ups; general health questions.
Not appropriate for: emergencies, severe acute illness, new/severe chest pain, shortness of breath, severe abdominal pain, mental health crises, or any condition requiring immediate in-person care. Call 911 for emergencies.
The Platform and all content are owned by KZ Wellness, PLLC or its licensors and protected by intellectual property laws. Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for personal, non-commercial purposes. All rights not expressly granted are reserved. You may not copy, distribute, modify, frame, scrape, or use automated means to access the Platform without permission.
By using the Services, you consent to receive communications (e.g., email, Practice Better messages). You acknowledge that unencrypted email may not be secure. Notices, disclosures, and agreements sent electronically satisfy legal “in writing” requirements.
We protect your information using administrative, technical, and physical safeguards, including TLS encryption in transit, secure HIPAA-compliant hosting, access controls, MFA where applicable, audit logs, and session timeouts. See our Privacy Policy and Notice of Privacy Practices for details. While we use strong safeguards, no system is 100% secure.
You agree to pay all fees at the prices in effect when charges are incurred and authorize KZ Wellness, PLLC to charge your selected payment method (your “Payment Method”) for Services. If your Payment Method is invalid, you agree to pay amounts due upon demand. We may correct billing errors, even if payment has been requested or received.
Payments are processed by Stripe. Your use of Stripe is subject to Stripe’s terms and privacy policy.
Membership, billed in advance; auto-renews each billing cycle until cancelled. Membership includes telehealth visits, secure messaging, and nutrition/exercise guidance. Medications and third-party services are not included.
Cancel anytime by emailing kzwellness@kzwellnesspllc.com from your account email. Cancellation takes effect at the end of the current billing cycle (no partial refunds). We may offer refunds/credits at our discretion for billing errors, duplicate charges, unauthorized transactions confirmed after investigation, or if the platform was unavailable for a material portion of a cycle. A one-time refund/credit does not require future refunds/credits.
We may suspend/terminate Services for non-payment. Past-due balances may be charged to any Payment Method on file and may be referred to collections (you agree to pay reasonable collection costs and attorneys’ fees as permitted by law).
Certain products require a valid prescription from a Provider after clinical evaluation. Prescriptions (e.g., GLP-1/GIP therapies when clinically appropriate) are sent to the Eli Lilly pharmacy. Medication costs are separate and billed by the pharmacy. KZ Wellness, PLLC makes no representation about insurance coverage for medications. We will help with prior authorization if eligible through your insurance, however cannot guarantee acceptance.
KZ Wellness, PLLC and Providers do not prescribe controlled substances. Prescribing decisions are made solely by the Provider, consistent with law and clinical judgment.
Labs are purchased through Quest in your own account. KZ Wellness, PLLC does not order labs and is not responsible for lab pricing, billing, or coverage determinations.
Third parties (Providers, Pharmacies, Therapy) may offer goods/services through or linked from the Platform. Your interactions with third parties are solely between you and those parties. KZ Wellness, PLLC is not liable for third-party acts, omissions, products, services, or content. Investigate as you deem appropriate before transacting with any third party.
Services are currently available only to patients physically located in Connecticut at the time of telehealth visits and otherwise within the United States. We may change availability, requirements, or offerings at any time.
Providers may determine that your condition requires in-person care. In that case, you may be referred for alternative care and may not continue with certain Services.
If you create an account, you agree to provide accurate, current information and to maintain the confidentiality of your credentials. You are responsible for all activities under your account.
You may not: access data not intended for you; probe/scan systems; bypass security; use scrapers/robots; interfere with the Platform; or use the Services in violation of law or these Terms. We may suspend or terminate access with or without cause.
Do not submit information that is false, unlawful, infringing, harmful, or that contains malware. You represent you have the legal right to provide all information you submit. You agree not to solicit other KZ Wellness, PLLC users.
We do not verify your HSA/FSA eligibility. Consult your benefits administrator regarding eligibility and potential impact of payments on your HSA/FSA status.
If you believe content on the Platform infringes your copyright, send a notice including the required DMCA elements to kzwellness@kzwellnesspllc.com with “DMCA Notice” in the subject line.
THE PLATFORM AND SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT DEFECTS WILL BE CORRECTED. YOU ARE RESPONSIBLE FOR BACKUPS AND SECURITY OF YOUR DEVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KZ WELLNESS, PLLC AND ITS AFFILIATES, LICENSORS, AND SERVICE PROVIDERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS OR DATA) ARISING OUT OF OR RELATED TO THE PLATFORM, SERVICES, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO KZ WELLNESS, PLLC IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations; some limitations may not apply to you.
YOU AGREE that any dispute arising out of or relating to these Terms or the Services will be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You waive the right to a jury trial and to participate in a class action.
Arbitration will take place in Hartford County, Connecticut, unless otherwise agreed.
The arbitrator may award the same remedies a court could on an individual basis.
No class, collective, or representative actions are permitted. Claims must be brought individually.
Either party may seek injunctive relief in a court of competent jurisdiction for intellectual property or unauthorized access/use claims.
You may opt out of arbitration by sending written notice to kzwellness@kzwellnesspllc.com within 30 days of first accepting these Terms.
Any claim arising out of or relating to these Terms or the Services must be filed within one (1) year after the claim accrues, otherwise it is permanently barred.
These Terms are governed by the laws of the State of Connecticut, without regard to conflicts of law principles. For claims that may be brought in court (e.g., injunctive relief), the parties submit to the state and federal courts located in Connecticut.
You agree to comply with U.S. export control laws and not to export or re-export the Platform where prohibited. The Platform is “commercial computer software” as defined in 48 C.F.R. § 2.101.
We are not liable for delays or failures beyond our reasonable control (e.g., acts of God, pandemics, war, labor disputes, utility failures, or other force majeure events).
You agree to defend, indemnify, and hold harmless KZ Wellness, PLLC and its affiliates, officers, directors, employees, and agents from and against claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Services.
We may monitor general use and remove materials we deem inappropriate. We may modify or discontinue any part of the Services at any time. We may terminate or suspend your access with or without cause or notice.
If any provision is unenforceable, the remainder will remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms; we may assign them. These Terms, together with the Privacy Policy, Notice of Privacy Practices, Telehealth Consent, and any plan-specific terms at checkout, constitute the entire agreement between you and KZ Wellness, PLLC.
